TERMS AND CONDITIONS of the Premium Traveller Christmas 2014 RAFFLE “Ask us for your Christmas present”
FIRST.- ORGANISER
Gestió i Serveis Trade Center S.A. (henceforth “GISTC”), company tax code number A-61.710.687, whose registered office is in Barcelona, Moll de la Barcelona s/n,edificio este 1ª Planta, 08039, is organising the “Ask us for your Christmas present” raffle, which is a random combination for publicity or promotional purposes (henceforth “RAFFLE”) aimed at all persons participating in it.
SECOND.- NATURE, AND SUBJECTIVE, GEOGRAPHICAL AND TIME FRAME SCOPE OF THE CAMPAIGN
The nature of this RAFFLE is a “random combination for publicity purposes” subject to Generalitat Decree 397/2011 and Law 13/2011, and any other applicable regional and State regulations.
This RAFFLE is regional (Barcelona) in scope and open to any natural person of legal age, regardless of their nationality, and whether or not they reside in Barcelona or elsewhere.
The duration of this promotional Raffle is initially envisaged at one (1) month, from 6th December 2014 to 6th January 2015, both inclusively.
Since the promotion is taking place on the internet, its geographical scope is unrestricted.
Persons involved in a labour relationship with GISTC during the period of duration of the Raffle, i.e., from 6th December to 6th January, both inclusive, may not take part in this promotion.
THIRD. -PARTICIPATION IN THE RAFFLE AND TERMS OF OPERATION
All users registering for this Premium Traveller campaign through the following website form and ticking the “I accept the terms and conditions for taking part in the raffle” box will be eligible to participate in this campaign:

Any person wishing to participate will have the right to register once for the Premium Traveller newsletter. Each customer may only take part in the Raffle once, so any irregularity detected in that regard will oblige the organisation to exclude persons found to have committed an irregularity from the Raffle.
The RAFFLE will be held among all the participants who register for it. The winner of the raffle will be chosen randomly using the http://www.alazar.info/generador-de-sorteosapplication. The participants’ data, i.e., email address, name and surname will be entered in said application. The application itself will then choose the winner. The winner will receive a prize valued at 150 euros to be used in Premium Traveller services up to 30th June 2015. (See Prize section in these terms and conditions).
Another participant will also be chosen randomly as a reserve. Should it not prove possible to locate the winner, the reserve will be contacted.
Once the winner has been selected, an e-mail containing the information needed to make use of the prize will be sent to him/her. The winner’s name will be published:
- On the @premtraveller Twitter account.
- On the first possible newsletter published in 2015
Participating in the Raffle implies acceptance that the winner’s name will be published in either of those two media.
FOURTH.- PRIZE
The prize pertaining to this promotion will be a coupon valued at 150 euros to make use of Premium Traveller services:
The prize is in the winner’s name but may be transferred to another person chosen by said winner, who must inform GISTC in writing of the person’s full names, company, position, personal telephone number and e-mail address, and include a signed photocopy of the person’s ID. Once assigned, it can not be transferred again.
The prize may be used from 31st January 2015 to 31st December 2015. The prize includes a service for one or several persons worth a maximum of 150 euros, to be used in a single day (including the following Premium Traveller services):
- Premium Air Rooms Barcelona: guest rooms in Barcelona Airport’s Terminal 1
- Premium Air Rooms Madrid: guest rooms in Madrid Airport’s Terminal 4
- Premium Air Lounges: 4 VIP Lounges in Barcelona Airport, in Madrid Airport’s Terminal 4 arrivals lounge, and in other airports in which we market accesses to VIP Lounges
- Premium Air Wellness & Spa: inside Barcelona Airport
- Premium Parking: Barcelona Airport
- Premium Air Meetings: offices for business meetings

The prize depends on service availability and may not be added to other promotions.
The prize may not be exchanged for its cash equivalent or for any other prize.

FIFTH.- DESIGNATION OF THE WINNER, NOTIFICATION AND ACCEPTANCE
The RAFFLE will be held among all the participants who have registered for it. The winner of the raffle will be chosen randomly and reviewed by a GISTC team at GISTC’s registered offices, using the following application:http://www.alazar.info/generador-de-sorteos. The participants’ data, i.e., email address, name and surname will be entered in said application. The application itself will then choose the winner. The winner will receive a prize valued at 150 euros to be used in Premium Traveller services up to 30th June 2015. Given the nature of the raffle, the organisation considers that the composition of the jury and its mechanisms and components ensure the full transparency of the process, thus making the intervention of a notary in this raffle unnecessary.
GISTC will notify the winner within a period of seven (7) days following the holding of the raffle, using the telephone number or e-mail indicated in the newsletter registration form. The winner must respond within five (5) days of receiving notice from GISTC that he/she has won the prize, by confirming acceptance of the prize and providing all the information required by GISTC to process the ownership of the prize, or, if applicable, the awarding of the prize to another person. Once he/she has been contacted, the winner will be sent an explanatory e-mail containing indications for the receipt of the prize.
If the winner declines or fails to reply in the five- day (5) period following GISTC’s notice of his/her award, the prize will be awarded to the runner-up, who must reply to GISTC’s notice of his/her award within a period of five (5) natural days. Should the second runner-up also decline or fail to reply in the period of five (5) natural days following notification, the prize will be declared null and void. In the latter case, GISTC will have no obligation to hand over the prize to any other participant, the prize will remain null and void, and may not be claimed subsequently by the winner or the runner-up.
GISTC will be exempt from any liability stemming from possible errors in the information provided by the winner, in the event that identification is not possible. Similarly, GISTC may not be held liable if the e-mail or the notification of the prize is not delivered due to an error in the e-mail address or the telephone number furnished by the participant in the application form, a breakdown in the access provider, in the event of Internet failure, or for any other reason.
SIXTH.- PUBLICITY
GISTC reserves the right to publish the name and image of the winner on any kind of support either for publicity or any other purposes, whether on the Internet or not, and anywhere in the world, without the winners seeking any form of compensation or opposing said right, unless they decline the prize. Taking part in the raffle is therefore understood to imply authorisation of the aforementioned use of the winner’s name.
The winner will grant an interview to GISTC staff if GISTC requests it, and will allow GISTC to make use of the images obtained during, prior or following said interview for use worldwide, indefinitely and for free in subsequent GISTC publicity campaigns.
SEVENTH.- PROTECTION OF PERSONAL DATA
We hereby inform you that by taking part in this raffle your data will be registered in a database owned by Gestió i Serveis Trade Center S.A. As stipulated in Basic Law 15/1999 of 13th December on Protection of Personal Data, Gestió i Serveis Trade Center S.A. hereby informs users of the existence of an automatic database for personal data created by and for GISTC under its responsibility, and that such data will remain in the database as long as they are considered of use in rendering, offering and processing our services, for sending you information and publicity on GISTC offers, promotions and recommendations, and for conducting commercial operations, surveys, statistics and analyses of market trends. In that regard GISTC will ensure full compliance with the Law on Services of the Information Society and Electronic Commerce.
You may exercise your right to access, rectify, cancel and oppose the use of such data by sending a letter to Gestió i Serveis Trade Center S.A., Moll de Barcelona s/n, Edificio Este, 1ª planta, 08039- Barcelona, or an e-mail to containing the words BAJA E_promocion_navidad_2014 or RECTIFICACION_DATOS in the subject field, and indicating the changes to personal information you wish to make. With regard to security in the use of your personal data, these will be treated confidentially by GISTC, which pledges to apply all the stipulations set forth in RD 994/1999 of 11 June on Security Measures for Automatic Databases containing personal data to its equipment and servers.
EIGHTH.- LIMITED LIABILITY
GISTC is hereby exempted from liability if, owing to force majeur, circumstances beyond its control, or justifiable reasons, it is forced to cancel, shorten, extend, postpone this Raffle or modify its terms and conditions, and may not be held liable on such grounds. In any event, GISTC reserves the right to extend the period of participation.
GISTC especially disclaims any liability in the event that the addresses provided by the participants are destroyed for reasons not attributable to the company. GISTC disclaims any liability in the event of incidents concerning computer use, access to Internet, telephone lines or any other technical problems.
Similarly, GISTC may not be held liable for any direct or indirect damage stemming from the interruption, flawed operation, suspension or ending of the Raffle or other reason, nor for direct or indirect damage of any kind of the website connection. GISTC reserves the right to sue anyone committing fraud or attempting to do so. In any event, it may not be held liable by raffle participants for any fraud that may have been committed.
GISTC will be exempt from liability for administrative or any other steps taken by the winner to obtain the documentation needed to claim the prize.
NINTH.- DEPOSIT AND ACCEPTANCE OF TERMS AND CONDITIONS
Registering to take part in the raffle implies reading, unconditionally accepting and respecting these terms and conditions, which may be accessed at the front desks of the Barcelona Airport VIP Lounges. Participants may request copies of the terms and conditions.
TENTH.- TRADEMARK RIGHTS AND COPYRIGHT
The images used, objects represented, aforementioned commercial brands and names, graphic and information technology components and databases featured on the website are the sole property of Gestió i Serveis Trade Center S.A. and may not be removed, reproduced or used without the written consent of their holders under penalty of civil actions and/or criminal proceedings
ELEVENTH. LAWSUITS
These terms and conditions are subject to Spanish law. Any claims pertaining to the Raffle must be sent in writing to Gestió i Serveis Trade Center, S.A. at the following address, for attention by the GISTC Marketing Department: Moll de Barcelona, s/n 1ª planta Edificio Este (World Trade Center Barcelona), thirty (30) days prior to the deadline for participating in the Raffle, as indicated in these Terms and Conditions. In the event of a dispute in the application or interpretation of these Terms and Conditions and the absence of an out-of-court settlement, all litigation will be subject to the jurisdiction and competence of the Courts and Lower Courts of the city of Barcelona, hereby expressly waiving any other jurisdiction corresponding to either of the parties.
